The ordinance, which is being debated in the district committees and the Council, would ban lingering on public parking areas between 10:00 PM and 6:00 AM. Fines of up to 1,000 euros may be imposed for violations.

The ordinance is attributable to the responsible authority, the municipal police, and is based on §§ 27 and 31 of the Law on Authorities Responsible for Municipal Order (OBG). The city argues that the ban will prevent displacement effects and make it more difficult for the poser scene to congregate.

Criticism and the Focus on Proportionality

The FDP Council faction expressed concerns about the proportionality of a city-wide ban. In a written question, the faction inquired about existing measures such as noise measurement concepts or structural changes to address the root causes of disturbances to rest. The FDP also asked whether exceptions for events such as fairs or wedding receptions are planned and whether these would be associated with fees. The administration emphasized that the ban is not intended to increase fee revenues or bureaucracy, but rather to complement existing measures.

In addition, the use of a noise measurement device such as the "Lärmblitzer" (Noise Flasher) was discussed. This device, which was tested as a research project in Berlin, is not admissible in court and is not legally permissible in Germany. As a result, authorities are relying on increased patrols by the Local Order Service (KOD) and the use of a noise control vehicle during the summer months.

Alternatives and Evaluation Plans

The Left Party and echt.Remscheid jointly submitted a motion requesting an evaluation of existing measures against reckless driving and noise disturbances before an anti-hanging-out ban is enacted. Following the death of Hanna in May 2025, which was caused by excessive speed, they are calling for reliable structures, continuous controls, and sustainable changes in traffic behavior. An evaluation report after 12 months is planned to assess the effectiveness of the measures.

The Greens (Bündnis 90/Die Grünen) also rejected a blanket anti-hanging-out ban and instead demanded structural traffic calming measures such as speed bumps, 30 km/h zones, and clearer markings for cyclists. The faction argues that targeted and legally sound solutions are preferable to a blanket ban.

The discussions on the anti-hanging-out ban and traffic calming in Remscheid show how complex the issue is. The city must balance safety, proportionality, and citizens' rights. While the Council did not make a final decision in April 2026, the next meetings in May will be decisive.
