Property Tax Reform and Budget Implications in Gevelsberg in April 2026
In April 2026, Gevelsberg took decisive steps toward reforming property tax B and utilizing funds from the urban development project. These decisions have far-reaching financial and legal implications for the city.
Property Tax Reform and Legal Uncertainty
Property tax policy in Gevelsberg was at the center of attention in April 2026, as the city was forced to reconsider its differentiated tax rates for residential and non-residential land due to two rulings by the administrative courts in Gelsenkirchen and Düsseldorf. The differentiated rates—1,460 ‰ for non-residential land and 739 ‰ for residential land—were deemed unlawful, as they were considered to violate the principle of tax fairness.
In response, the municipality filed an appeal with the Higher Administrative Court of North Rhine-Westphalia, but legal uncertainty remains. Against this backdrop, the recommendation to adopt a uniform tax rate of 915 ‰ for property tax B is particularly relevant. This step would minimize legal risks and ensure financial stability.
Budget Implications of the Reform
Switching to a uniform tax rate has significant implications for the municipal budget. If the differentiated rates had been maintained, Gevelsberg could have faced a tax loss of up to 0.9 million euros in 2026. This amount represents a considerable portion of the expected property tax revenue of 7.4 million euros for that year. By comparison, the pre-reform level was 7.1 million euros, indicating that the reform also includes a certain degree of revenue stabilization.
Adopting the rate of 915 ‰ means a reduction of the tax rate for non-residential land by 37.3 percent and an increase for residential land by 23.8 percent. Under the pre-reform methodology, the new rate corresponds to 695 ‰ according to the old law, meaning that the actual tax rate—adjusted for inflation (consumer price index increased by 26 percent from 2017 to 2025)—effectively decreases.
Urban Development Project Berge-Knapp and Vogelsang
In addition to the property tax reform, the implementation of the urban development project Berge-Knapp and Vogelsang was also a focus. The grant funds, which cover 70 percent of the measures' costs, are only available in 2026. Therefore, the city of Gevelsberg is under pressure to implement the measures in a timely manner to avoid losing valuable financial support. Fortunately, no significant changes to the construction costs due to design modifications were identified, which simplifies the planning process.
Outlook and Challenges
The decisions made in April 2026 illustrate how closely financial planning and legal certainty are linked in municipal financial policy. Gevelsberg faces the challenge of choosing a uniform tax rate that ensures tax fairness and financial stability without endangering social acceptance. At the same time, the city must align its investment plans—particularly in urban development projects—with the available grant funds.
The coming months will show whether the appeal before the Higher Administrative Court of North Rhine-Westphalia is successful and how the city of Gevelsberg manages the transition to a uniform tax rate to minimize financial risks while fulfilling its social responsibility.
