Despite comprehensive consultation with 27 authorities and public interest stakeholders, the plan remained largely unchanged, even though concerns about forest areas and avenue trees persisted. Although an environmental report was prepared to assess the impact on protected resources such as soil, water, and wildlife, the statement from the Forestry Office remained critical. The forest areas to be affected contribute to the landscape and are located within the landscape protection area "Teupitz-Köriser Seengebiet."
Nature Conservation and Climate Protection Forest: Conflict with Planning Projects
A central conflict arose in connection with the residential development project on a 2.2 ha area between B179 and the eastern shore of the Pätzer Vordersee. Due to the contradiction with the protection regulations of the landscape protection areas Teupitz-Köriser Seengebiet and Dahme-Heideseen, the project was rejected. The affected area included 0.5 ha of local climate protection forest and two avenues, with at least three avenue trees needing to be felled. A release under § 67 Abs. 1 BNatSchG was not granted.
The rejection underlines the stringency of nature conservation laws and shows that not every project, even if economically viable, can be implemented. The municipality is required to act as an intermediary between urban development interests and ecological protection needs.
Legal and Technical Challenges
The planning in Bestensee is not only ecologically, but also legally and technically complex. In March 2026, updated legal foundations were considered, including source annotations and certification notes. E.DIS Netz GmbH, which operates the power supply in the planning area, requested timely planning information to avoid potential conflicts.
In addition, urban development usage concepts were revised, particularly for the community center, with the possibility of expanding the pediatric practice also being considered. This detailed planning shows that Bestensee not only focuses on larger projects, but also places small yet central infrastructure facilities in the spotlight.
