The ordinance was developed in close cooperation with regional economic associations such as the Handelsverband Bayern e.V. (HBE), the Innenstadtgewerbebeirat (IGB), and the Industrial and Commercial Chamber (IHK), in order to take both economic interests and social aspects into account.

Balanced Interests: Economic Development and Workers' Rights

The ordinance is based on a balanced compromise between economic interests and the protection of workers' rights. Although the city has the right to allow up to eight open shopping nights, it has deliberately chosen five dates. This reduced scope reflects the goal of maximizing economic benefits while avoiding excessive burdens on employees' working hours.

Another compromise is the differentiation of opening hours: While the ordinance generally allows stores to remain open until 12 a.m., only until 10 p.m. is recommended for March 27. This step was taken to reduce the burden on employees and to consider customer frequency and safety during the late evening hours.

The ordinance does not include a mandatory requirement to open sales premises on the specified days. This means that retailers are free to decide whether to participate in the open shopping nights. At the same time, it remains possible to organize up to four additional open shopping nights through individual events.

Practical Implementation and Evaluation: What Comes After 2026?

Augsburg has set itself the objective of evaluating the Shopping Night Ordinance 2026 as a pilot project. The aim is to develop a long-term concept based on the experiences gained. The ordinance already contains provisions for analyzing seasonal effects, for example, on sales, customer loyalty, and competitive advantages against online retail.

Another practical tool is the online form for registering open shopping nights. This is intended to facilitate retailers' participation in the open shopping nights and to reduce the administrative burden. The ordinance is valid for the year 2026 and came into force the day after its publication.
