The retroactive appointment, effective from July 1, 2024, was therefore legally flawed. Although the decisions of the works council are still considered valid, legal uncertainties remain. The DIE LINKE faction criticized the action as constitutionally questionable and pointed out the general inadmissibility of retroactive appointments in public law.
This situation highlights the need to revise the municipal enterprise ordinance in the future in order to avoid time gaps in the appointment of employee representatives.
Performance-Based Pay: A Pilot Project Under Discussion
Another focus of the meetings was the pilot project "Performance-Based Pay" for facility managers in daycare centers. This model links performance and pay, which could potentially create motivating structures at the management level.

The administration emphasized that the model is still in the evaluation phase and will be further developed in close cooperation with the employee representatives.

At the same time, the occupancy rates in some facilities are falling short of the planned values, indicating regional differences and structural bottlenecks.
